1. Agreement to Terms

By accessing or using NoBusyWork's website (nobusywork.ai) and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

NoBusyWork provides managed websites, hosting, connected workspaces, and related business-software services for small businesses. The exact deliverables, supported workflows, implementation scope, and service level are described in the proposal, order form, or other agreement for your purchase.

You are responsible for providing or approving accurate business information, content, branding, and instructions used to deliver the service. Unfinished roadmap capabilities are not included unless they are expressly listed in your agreement.

If you provide a phone number and expressly opt in, NoBusyWork may send customer-care text messages related to your request, onboarding, appointments, and service updates. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to cancel. Consent is not a condition of purchase.

3. Account Registration

Some services require an account. If an account is provided, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Fees & Billing

Pricing, billing cadence, minimum terms, and included services are stated in your proposal, order form, or subscription confirmation. By purchasing, you agree to:

• Pay the applicable one-time, recurring, usage-based, or add-on fees listed in your agreement
• Pay recurring charges in advance according to the billing schedule in your agreement
• Pay fees in US dollars; refunds are available only as stated in your agreement or required by law
• We may change future recurring pricing with 30 days' written notice, subject to any fixed term in your agreement

5. Cancellation, Commitments & Refunds

Cancellation and transfer rights depend on the payment option and commitment stated in your agreement.

• You may request cancellation of ongoing services according to your agreement
• Any minimum term or unpaid website-build commitment remains governed by your agreement
• No partial refunds are issued except where your agreement or applicable law requires one
• Website content ownership, domain access, and any transfer assistance are governed by your agreement

6. Acceptable Use

You agree not to use our services to:

• Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, TCPA)
• Harass, abuse, or harm any person through AI-generated communications
• Misrepresent the AI as a human when legally required to disclose AI usage
• Transmit malware, viruses, or any destructive code
• Violate any applicable local, state, national, or international law
• Use the service for any illegal, fraudulent, or deceptive purpose

7. AI-Assisted Features

If your agreement includes an AI-assisted feature, the following additional terms apply:

• The AI may occasionally produce inaccurate or inappropriate responses
• You are ultimately responsible for reviewing and approving AI-generated communications sent on your behalf
• The AI does not provide legal, medical, financial, or professional advice
• We recommend configuring escalation rules for sensitive topics so conversations are routed to a human
• AI responses are generated based on the knowledge base you provide; incomplete or outdated information may lead to incorrect responses

8. Intellectual Property

You retain ownership of the original content, business information, and branding you provide. Ownership and licensing of website designs, templates, custom code, domains, and deliverables are governed by your agreement. We retain ownership of the NoBusyWork platform, software, and technology. We may use anonymized, aggregated data to improve our services.

9. Data Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

To the maximum extent permitted by law, NoBusyWork shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of our services.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by:

• Scheduled maintenance (with advance notice)
• Third-party service outages (cloud providers, LLM APIs)
• Force majeure events
• Your internet connectivity or device issues

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees. Upon termination, your right to use the service ceases immediately. You may request a data export within 30 days of termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website at least 30 days before taking effect. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
